Artificial Intelligence, in the form of social or chat bots, is evolving into a communications partner for humans and at the same time creating remarkable artwork. Against this background, Amelie Rossipaul examines the question of AI's legal status. With reference to the constitutional right to freedom of expression and artistic freedom, this status is first outlined in terms of constitutional rights theory and then based on concrete cases of application.

Künstliche Intelligenz macht auch vor der Kommunikation und Kunst keinen Halt. Im Gegenteil schwingt sie sich in Form von Social oder Chat Bots immer stärker zu einem Kommunikationspartner des Menschen auf und vollbringt in der Kunst in Kooperation mit dem Menschen, aber auch vollkommen eigenständig, erstaunlich kreative Leistungen. Vor diesem Hintergrund geht Amelie Rossipaul der Frage nach, wie sich kommunikative und kreative Künstliche Intelligenz in das (Grund-)Rechtssystem integrieren lässt. Dabei handelt sie die fragilen Beziehungen zwischen Mensch und Maschine unter Berücksichtigung der Anthropozentrik der Rechtsordnung juristisch aus und begründet einen eigenen (grund-)rechtlichen Status Künstlicher Intelligenz. Dieser wird für die Meinungs- und die Kunstfreiheit (Art. 5 Abs. 1 und 3 GG) ausdifferenziert, um schließlich die jeweiligen grundrechtstheoretischen Überlegungen anhand konkreter Anwendungsfälle fruchtbar zu machen.
